Tungkol sa Kasal at kunin ang "Marriage Visa" (kapag over-stay at walang Passport)

 *)日本には「婚姻ビザ」というものは存在しません。「日本人の配偶者等」というビザになりす。また、在留資格のない方が日本で結婚し取得できるビザは、この「日本人の配偶者等」ではなく、「在留特別許可」というものになります。しかし、ここでは、「婚姻ビザ」という表現を理解しやすいので使用していきます。

 FIpilino/Filipina - Three ture copy of Authenticated Birth Certificate (NSO, Malacanang, DFA) at copy of its Japanese translation (if divorced)

Hapon - One or two true copy of Koseki Tohon (Family Registry) & one copy of its English translation (if divorced)
日本の方は「戸籍謄本」ー1〜2通(その英語訳文ー1通

Susunod 次に
 Hapon - Two true copy of bagong Koseki Tohon (Family Registry) - dapat inilagay ang nagpakasp na kayo sa loob ng Koseki Tohon (Family Registry) at copy of its English translation (if divorced) , Passport at Xerox ng Passport.
 新しい(婚姻の事実が記載された)「戸籍謄本」2通、その英語訳ー1通、日本の方のパスポート(そのコピー)。

Certificate of Marriage (kunin ninyo sa Philippines Embassy) at iba pa.

 At saka dapat ihanda ng Hapon ang ilang dokumento, halimbawa,Certificate of Tax Payment, Certificate of trabaho at iba pa.

What is required before a Filipino can marry a Japanese in Japan?

A Certificate of legal capacity to contract Marriage is required. This certification can be issued at the Philippine Embassy in Tokyo and the Philippine Consulate General in Osaka. The Certificate of Legal Capacity to Contract Marriage is valid only within the territorial jurisdictional of Japan and valid only for a period of 180 days from date of issue.

What are the Requirements for Obtaining a Certificate of Legal Capacity to Contract Marriage?

The Filipino must submit the following documents:
Application form duly accomplished
Passport and two (2) copies of pertinent pages
3 Authenticated Birth Certificate and two(2) copies
4 Authenticated Single or Joint Affidavit of Parents stating that the applicant is single and has the legal capacity to contract marriage; and if the applicant is between 18-21 years old, parental consent should be indicated and if between 21-25 years old, parental advice should be indicated (only in cases where the applicant has never contracted any previous marriage) and two (2) copies
Decree of Divorce (only in cases where the applicant is legally divorced) and two (2) copies
Authenticated Death Certificate (only in cases where a widow or widower) and two (2) copies
Affidavit of Single/Divorced/Widow/Widower Status
Family Registry or Koseki Tohon of Japanese contracting party and two (2) copies

For Divorced/Widowed Filipino & Japanese
"Legal Capacity to Contract Marriage" is issued only to a Filipino who is presently residing in Japan. As a basic requirement, both the Filipino applicant and his/her Japanese fiance have to appear personally at the Embassy. If a Filipino applicant is a female, she is required under Philippine law, to wait for 10 months and one day after her divorce, before she can apply for remarriage.

Requirements for Filipinos:
Amended passport or travel affidavit bearing maiden name-2 photocopies. (For female applicants only).
Presentation of the original passport or travel affidavit is required.

Report of Divorce from the Philippine Embassy (original & 1 photocopy). When a Filipino national has history of divorce with Japanese national, before he/she applies for remarriage, he/she has to file the Report of Divorce at the Consular Section of the Philippine Embassy.
Two (2) passport size pictures (4.5 cm x 3.5 cm)

Requirements for Japanese:
Family Registry (Koseki Tohon) original and 1 photocopy
The applicant should put FURIGANA on the address as well as the names of father, mother and child(ren). A Koseki Shohon is not acceptable.
Passport or Oficial ID Card (i.e. Driver's License) 2 photocopies. Presentation of the original passport or official ID is required.
Two (2) passport size pictures (4.5 cm x 3.5 cm)

What are the Requirements for the Solemnization of Marriage? Each contracting party must submit the following:
Application Form for Marriage License duly accomplished
Passport and two (2) copies of pertinent pages
Authenticated Birth Certificate and two (2) copies
Approval from Commanding Officer (if one of the contracting parties is a member of the U.S. Armed Forces, and two (2) copies
Two (2) photographs
Note:
Both the contracting parties must be citizens of the Philippines.
Affidavit of Consent/Advice of Parents for those between 18-21 years old and 21-25 respectively or a Divorce Decree or Death Certificate shall be required when applicable.
The marriage license shall be issued after the contents of the application has been posted in the bulletin board of the Embassy for ten (10) consecutive days.


 

[Paanng magpakasl at kunin ang Marriage Visa? 婚姻・ビザ申請(取得)までの流れ]
 Kunin ng Filipino/Filipina ang Travel Affidavit sa Philippines Embassy para magpakasal.

 Tapos,i-apply ang kasal sa City Hall. at saka kailangang i-apply ninyo ang Ninchi-todoke - Taiji-ninchi - (katulad ng makapirma ang Hapon sa Koseki Tohon (Family Registry) bilang pagpapatunay na ang sanggol ay siya ang ama maski buntis pa ang Filipina ) sa City Hall kasama ini-aplay ang kasal.

 Tapos,pumunta kayo sa Philippines Embassy para magpakasal kayo sa loob ng "Family Law" sa Philippines.

 Tapos, pumunta kayo sa Immigration para i-apply ang Visa.

 婚姻届を提出するために、フィリピン大使館絵で「一時旅券」を取得します。

 この「一時旅券」、「婚姻許可書」を取得したら、役所へ行き婚姻届を提出します。妊娠さえている方(フィリピン人が女性の場合)は、この時に「胎児認知」の届も必ずしてください

 婚姻が成立(戸籍に婚姻の事実が記載されたら)、フィリピン大使館で婚姻の事実を報告します。

 フィリピン国内法(「家族法」)での、婚姻も認められたら、出入国管理局へ行き「在留特別許可」の申し出をします。

What is the Procedure for the Issuance of a Report of Marriage?
For the issuance of "Report of Marriage," a "Legal Capacity to Contract Marriage" must first be applied at the Philippinie Embassy.
After receiving "Legal Capacity to Contract Marriage," please make three copies of said document
You and your husband/wife will take the "Certificate of Legal Capacity" along with other necessary materials to appropriate municipality (Kuyakusho, Shiyakusho, Machiyakuba, etc.) to complete your marriage
Ten (10) days after your marriage, your husband/wife will have a new Koseki Tohon (with your name already) which is issued by the municipality/city government
You will bring back to the Philippine Embassy these four (4) documents for the Report of Marriage:
New Koseki Tohon (to be translated at the Philippine Embassy and to be copied three times)
Copy of Certificate of Legal Capacity (3copies)
Passport or Travel Affidavit of Wife/Husband (3 copies)-Filipino
Passport or Driver's License of Husband/Wife (3 copies)-Japanese
If all required documents are in order and accepted, the Report of Marriage will be issued after three (3) working days (not counting the day of application and Sat., Sun., & holidays).

 1)Kunin muna ninyo(Filipino/Filipina) ang tatolung ture copy of Authenticated Birth Certificate (NSO, Malacanang, DFA) at copy of its Japanese translation (if divorced)
  フィリピンの方の出生証明ー3通、日本語への訳文ー2通を取り寄せてください。
  *)出生証明3通は、それぞれ、NSOのスタンプとマラカニアンの証明がついたものが必要です。
  *)日本語への訳文は、フィリピンで作成してもらった方が経済的負担が少なくてすみます。ただし、通訳・翻訳を業としている人に頼んでください(通訳者の署名・捺印が必要になります)

 2)Kunin ninyo (Hapon) ang tatolong Koseki Tohon (Family Registry) & one copy of its English  translation (if divorced)
  日本の方の戸籍謄本ー3通、英語への訳文ー1通

  *)英語への訳文に関しては、フィリピン大使館で行ってくれます(有料)。
  *)婚姻の成立後(日本国内法)、フィリピン大使館へ婚姻の報告をするときに必要になります。

 3)I-apply at kuni ninyo (Filipino/Filipina) ang Travel Affidavit sa Philippines Embassy.
  フィリピン大使館で、「一時旅券(アフダビ)」の申請・取得をします。

What is a Travel Affidavit? When is it required?

A Travel Affidavit is a document issued in lieu of a passport, to an individual who claims Philippine citizenship. It is valid only for sixty (60) days extendible only once for another thirty (30) days after payment of the prescribed fee. It is valid only for a single and direct travel to the Philippines and automatically expires upon arrival in the Philippines.

What are the requirments for the issuance of a Travel Affidavit?

For Marriage with Japanese or Foreign National
One copy of accomplished interview form from the Assistance to National Unit of the Embassy (Sinumpaang Salaysay)
Accomplished Embassy Application for Travel Affidavit
One copy of Authenticated Birth Certificate (NSO, Malacanang, DFA)
One copy of Authenticated Certificate of Non-Availability of Marriage from the National Statistics Office (Malacanang, DFA) if single
One copy of Koseki Tohon (Family Registry) & one copy of its English translation (if divorced)
Three pictures (4.5 x 3.5 cm), each with applicant's signature on the right side
One copy of the old or expired passport (if available)
* personal appearance is required for the release of the travel affidavit


 

 4)I-aplay ninyo ang magpakasal sa City Hall

 *)Kapag buntis ka na, i-apply ninyo ang Ninchi-todoke kasama i-apply ang magpakasal.
 *)妊娠されている場合(フィリピンの方が所背の場合)は、この時同時に「胎児認知」の届も出し  てください。

 5)I-applay ninyo ang magpakasp sa Philippines Embassy.
  フィリピン大使館へ「婚姻」の報告をします。

  Dapat ninyo ihanda ang s.s. dokumento;
  Bagong Koseki Tohon (Family Registry) - dapat inilagay ang nagpakasal na kayo sa loob ng Koseki Tohon -, at one copy of its English translation (if divorced)
