A General Overview of the Procedures and Requirements Related to the Marriage and Visa Application Processes

I. Getting Married and Applying for the Japanese Visa of the Marriage Partner
 婚姻手続及び査証申請までの手順
 フィリピンにおいて日本人とフィリピン人が結婚し、フィリピン人配偶者を日本に呼び寄せる場合には、以下の手順で婚姻及び呼び寄せ手続を行います。

Step 1. Apply for and receive a certificate of legal capacity to contract marriage.
This can be done at the Consulate General of Japan in Manila.
婚姻要件具備証明書の申請及び受領 (於:在マニラ日本国総領事館)  

Step 2: Apply for and receive a marriage license
This can be done at the city hall or the municipality in which the Philippine national resides.
婚姻許可証の申請及び受領 (於:フィリピン人婚約者居住地の市町村役場)

Step 3 Legally marry and sign the marriage certificate
フィリピンでの挙式及び婚姻証明書への署名

Step 4: Submit a report of marriage form to the appropriate Japanese officials.
This may be submitted to either the city hall in the city of Japan in which the Japanese national resides or to the Consulate General of Japan in Manila.

Step 5: Apply for and receive a certificate of eligibility.
This can be done through the office of the Japanese Regional Immigration Bureau that is closest to the city in Japan in which the Japanese national resides. :

Step 6 Apply for and receive the Japanese visa of the Philippine national.
This can be done at the Consulate General of Japan in Manila

II. Applying for a Certificate of Legal Capacity to Contract Marriage
 婚姻要件具備証明書の申請

 When a Japanese national wishes to enter into a contract of marriage with a Filipino, the Japanese national must apply for and receive a certificate of legal capacity to contract marriage from the Consulate General of Japan in Manila. This must be done prior to entering into a contract of marriage (Family Code of the Philippines, Article 21).

 Before receiving the certificate of legal capacity to contract marriage the following must be presented:
 フィリピンにおいて日本人とフィリピン人が結婚する場合には、日本人当事者は事前に在マニラ日本国総領事館より「婚姻要件具備証明書」を入手する必要があります。(フィリピン家族法第21条)
日本人当事者は下記(1)及び(2)の必要書類を用意して、在マニラ日本国総領事館証明窓口で申請して下さい。
なお、本証明書は申請頂いた翌開館日午後2時から3時の間に交付されます。(査証申請及び婚姻届等の際に本証明書のコピーの提出を求められる場合がありますので、本証明書入手後、数通コピーを作成しておくことをお勧めします。)

(1)Japanese Nationals: 日本人

A.  Certified true copy of your Japanese Family Register(Koseki Tohon) - 1 original
   戸籍謄本又は抄本 [発行後3ヶ月以内のもの] 1通

B.  Certified true copy of your Removed Japanese Family Register - 1 original
 This will be used for the divorced certification that is required by the Government of the   
 除籍謄本又は改製原戸籍 1通
 婚姻の事実があり、転籍等で戸籍から婚姻の婚姻の事実が抹消されている場合には以前の婚姻歴が記載 された除籍謄本又は改製原戸籍が必要となります。]

C.  Japanese passport - original 
   旅券(パスポート) [コピー不可]    原本

D.  Consent to marry - 1 original
   婚姻同意書 1通

If a male is over 18 years old or a female is over 16 years old but he or she is under 20 years old, a parental consent form must be submitted. This form must be completed and signed the  legal guardian of the Japanese applicant.
  注: 男18歳、女16歳以上で、20歳未満の未成年の方は、両親等法定代理人の承諾書が必要です。

Note:  Japanese males below the age of 18, and Japanese females below the age of 16, are not eligible for marriage.
※男18歳、女16歳未満の方は結婚できません)

(2)Philippine Nationals: フィリピン人

A.  Certified true copy of the applicant's birth certificate - 1 original
(The copy must have the original stamp/seal of a certified true copy) 
  出生証明書謄本 [原本と照合済みのスタンプがあるもの] 1通

If no birth certificate exists you must submit the following: 
出生証明書がない場合は、以下の書類が必要です。

   1. Certificate of non-record of birth - 1 original 
    This can be obtained from either the Local Civil Registrar or the National Statistics Office(N.S.O.)
    出生記録不在証明書 [市町村役場又は国家統計局発行のもの] 1通

   2. Baptismal certificate - 1 original 
    洗礼証明書       1通
    その他必要に応じ、追加書類を求める場合があります。

Note: Male and female Filipino applicants must be over the age of 18 to be eligible for marriage.
   18歳未満のフィリピン人の方は結婚できません。)

 The certificate of legal capacity to contract marriage will be issued one day after the application form is accepted. All certificates will be issued after 2:00 p.m. (Monday - Friday). Please be sure to make photo copies of the original certificate of legal capacity to contract marriage. These copies will be issued during the report of marriage and visa application submission phases of these processes.

 

III. The Marriage Procedure  フィリピン国内での婚姻手続き

Step I. After receiving the certificate of legal capacity to contract marriage both parties must proceed to the city hall or the municipality in which the Philippine national habitually resides.(where he or she has lived for at least the last 6 months). You must then both present the certificate of legal capacity to contract marriage to the  local civil registrar and apply for your marriage license. (Family Code of the Philippines, Article 9). Please refer all questions regarding the procedures and requirements necessary to apply for your marriage license directly to the local civil registrar issuing the marriage license.
婚姻要件具備証明書取得後、本証明書をもってフィリピン人婚約者が習慣的に居住している地域(例えば、少なくとも6ヶ月以上継続して居住している住所地)の管轄市町村役場に当事者双方が出頭し、婚姻許可証の申請をして下さい。(フィリピン家族法第9条)
 また、婚姻許可証申請の際の必要書類等詳細については、婚姻許可証を申請する予定の市町村役場に直接お問い合わせ下さい。

(注)婚姻要件具備証明書の有効期間は、婚姻許可証を申請する市町村役場によって異なりますので、婚姻許可証を申請する市町村役場に本証明書の有効期限を確認して下さい。

  Step 2. After applying your marriage license, the information given in the application will be posted for 10 consecutive days inside the city hall or the municipality in which the Philippine national habitually resides. The marriage license will be issued after the completion of this 10-day period (Family Code of the Philippines, Article 17).The marriage license, once issued, is valid in any part of the Philippines for 120 days. If it has not been used during this 120-day period it will then automatically expire (Family Code of the Philippines, Article 20)
婚姻許可証の申請後、申請者の氏名、住所及び婚姻許可申請書の記載事項が地方民事登記官事務所に継続して10日間公示されます。公示期間満了後、特に問題がなければ婚姻許可証が発行されます。(フィリピン家族法第17条)
 同許可証は発行日から120日間フィリピンのどの地域においても有効です。この期間内に同許可証を使用しない場合には同許可証は自動的に失効となります。(フィリピン家族法第20条)

  Step 3. The marriage ceremony must be solemnized by an individual with the legal authority to perform such a ceremony. Upon the completion of the ceremony all     participants (the presiding  official, the witnesses, and the husband and wife) must sign the marriage certificate (Family Code of the Philippines, Articles 2-7).
 フィリピンでは婚姻を挙行できる権限のある者(婚姻挙行担当官)が法律で定められています。判事又は牧師等がこの婚姻挙行担当官となっておりますので、これら婚姻挙行担当官及び成人に達した2名以上の証人の面前で結婚式を挙げ、婚姻当事者双方が婚姻証明書に署名をして下さい。(フィリピン家族法第2〜7条)

Step 4. Following the signing of the marriage certificate by all parties involved, the marriage certificate must be sent to the city hall or the municipality in which the  Philippine national habitually resides. It will then be registered by the local civil register. (Family Code of the Philippines, Article 23). Please remember to get certified true copies of the marriage contract from the local civil registrar. The  Japanese national will need these documents when the marriage is reported in Japan.
 挙式後、婚姻挙行担当官より婚姻証明書が挙式地のフィリピン市町村役場に送付され、これを受領した地方民事登記官が登録を行います。(フィリピン家族法第23条)
 登録された婚姻証明書の謄本は、「婚姻届」の提出の際に必要となります。

IV. Mandatory Registration of the Marriage in Japan 「婚姻届」の提出

Japanese nationals are legally obligated to submit a report of marriage form to the city hall of the city in Japan in which they reside, or to the Consulate-General of Japan in Manila, not more than 3 months after having entered into a contract of marriage with a Philippine national. The Filipino spouse of the Japanese national can submit the report of marriage to the Consulate General of Japan in Manila on behalf of the Japanese national provided that the necessary columns are completely filled out. When submitting the report of marriage to the Consulate General of Japan in Manila please have with you the following documents:
「婚姻届」の提出は、戸籍法上の義務となっています。フィリピンで結婚された方は、婚姻後3ヶ月以内に日本の市区町村役場又は在マニラ日本国総領事館へ「婚姻届」を提出して下さい。 
 婚姻届の必要書類が完備され、届出用紙が日本語で正確に記入されている場合に は、フィリピン人配偶者のみでも在マニラ日本国総領事館に届出ができます。
 在マニラ日本国総領事館に「婚姻届」提出される場合には、以下の書類が必要となります。なお、日本の市区町村役場に婚姻届を提出する場合には、市区町村役場に婚姻届提出の際の必要書類について直接お問い合わせ下さい。(在マニラ日本国総領事館の婚姻届の必要書類と異なる場合があります。)

A.  Certificates true copies of the Japanese national's Japanese Family Register (Koseki Tohon) - 2 originals 
  戸籍謄本又は抄本[日本人][できるだけ発行後3ヶ月以内のもの]  2通

B.  Certified true copies of the birth certificate of the Philippine national - 2 originals
  (These copies must have the original stamps/seals of certified true copies)
  出生証明書謄本[フィリピン人][原本と照合済みのスタンプがあるもの] 2通

If no birth certificate exists the following documents and their Japanese translation must be submitted:
出生記録がない場合には、以下の書類(それぞれ日本語訳文共)が必要です。

   1. Certificates of non-record of birth - 2 originals
    These can be obtained at either the office of the local civil registrar or the National Statistics Office (N.S.O.)
    出生記録不存在証明書 [市町村役場又は国家統計局発行のもの] 2通

   2. Baptismal Certificates. - 2 originals 
    洗礼証明書     2通

   3. Certificates of Nationality - 2 originals
   (or copies of your passport)Please present the original passport when submitting these copies
    国籍証明書(又は旅券(写))[旅券(写)の場合、原本を持参のこと] 2通

C.  Japanese translations of the birth certicate of the Philippine national - 2 originals
  (The translator's name must appear on these documents)
   出生証明書謄本の日本語訳文 2通

D.  Certified true copies of the marriage contract - 2 originals 
   2 originals These copies must have the stamps /seals of certified true copies and have the registration number in the city hall in the Philippines where the contract was registered. Do not submit abstracts of the marriage contract.
   婚姻証明書謄本[市町村役場の登録番号が記載され、原本と照合済みのスタンプがあり、抜粋式  でないもの] 2通

E.  Japanese translations of the marriage contract - 2 originals
(The translator's name must appear on these documents)

F.  Copy of the certificate of legal capacity to contract marriage - 1 copy 
  婚姻要件具備証明書(写)       1通

G.  Copy of the marriage license and marriage license application form - 1 copy each 
  婚姻許可申請書及び婚姻許可証(各写) 各1通

Note: If the Japanese national is changing the "Honseki" then 2 originals and 1 copy of    the above documents must be submitted.
(注)婚姻により新本籍を設ける場合は、上記の書類は3通づつ必要となります。なお、提出枚数が2通となっている書類については、うち1通はコピーでも結構です。

If the report of marriage is to be submitted to the city hall of the city in Japan in which the Japanese national resides, you must contact that city hall directly to inquire as to the requirements and procedures of that particular city hall.

 

V. Visa Application Procedure for Citizens of the Philippines Planning to Reside in Japan After Marrying a Japanese National  フィリピン人配偶者の査証申請手続

A. Overview of the application procedure

Step 1: The marriage must be officially registered at the city hall of the city in Japan in which the Japanese nationals resides.

Step 2: The Japanese national must, on behalf of his or her Filipino spouse, apply for a certificate of eligibility at the Regional Immigration Bureau office in Japan that is     closest to the city in which the Japanese national resides.

Step 3: After receiving the certificate of eligibility, the Philippine national must then apply for his or her Japanese visa at the Consulate-General in Manila.

All Filipino visa applicants who intend to reside in Japan after marrying a Japanese national must first receive a certificate of eligibility. The certificate must be obtained at the Regional Immigration Bureau office in Japan that is closest to the city in which the Japanese national resides. Please direct all inquiries as to the procedures and requirements necessary to receive a certificate of eligibility to the Regional Immigration Bureau office in Japan that will be issuing the certificate.

Note: If the Japanese national is changing the "Honseki" then 2 originals and 1 copy of the above documents must be submitted.  

  在留資格認定証明書の申請及び受領(於:日本の各地方入国管理局)日本人と結婚し日本で生活しよう とするフィリピン人の方が査証申請をする場合には、法務大臣(法務省入国管理局)の発給する「在留資格認定証明書」が必要となります。
 本証明書は、日本の市区町村役場等に婚姻届の提出を行った後、日本人配偶者が最寄りの地方入国管理局 に申請して発給を受けて下さい。

Dapat kunin ang "Certificate of Eligibility" para magpakasal kahit sino.I-aplay ang "certificate of Eligibility" sa Japan lang.Ibig sabihin ito,hindi puwede i-aplay ang "Certificate of Eligibility" sa Pilipinas.At saka dapat ihanda ng Hapon ang ilang dokumento para sa "Certificate of Eligibility".Halimbawa,Certificate of Tax Payment, Certificate of trabaho at iba pa.Dapat kunin ang Application Form at itanon sa Immigration tungkol sa "Certificate of Eligibility".
「在留資格認定書」は日本国内で申請します(フィリピンでは申請できませんし取得もできません)。{在留資格認定書」を申請する際に、納税証明書(源泉徴収票)など、必要な書類がいくつかあります。出入国管理局で「在留資格認定書」の申請書を取得し、説明を受けて下さい。

B. Japanese visa requirements
査証(VISA)申請(於:在マニラ総領事館) 必要書類

1.Completed visa application form and 2 photos (4.5 x 4.5 cm)
 査証申請書(写真2枚添付(サイズ:4.5cm×4.5cm))

2.Valid passport
 旅券

3.Old or expired passports (if any)

4.Certificate of eligibility (1 original and 1 copy)
 在留資格認定証明書(原本1部、コピー1部)

5.Certified true copy of the birth certificate of the Philippine national on "Security Paper"  from the National Statistics Office (If no birth certificate exists the Philippine national must present a certified true copy of his or her non-record of birth certificate from the National Statistics Office)
 出生証明書謄本(国家統計局発行(NSO)のセキュリティ ー・ペーパーを用いた謄本。国家統計局に 記録がない場合 には、同局発行の出生記録の不存在証明書及び市町村役 場発行の謄本で国家統計局の 認証のあるもの。)

6.Certified true copy of the marriage contract on "Security Paper" from the National    Statistics Office
 婚姻証明書謄本(同上)

上記の他、追加書類を求める場合もあります

注)上記c.は発行日より3ヶ月以内、上記d.及びe.については発行日より6ヶ月以内のものを提出して下さい。

C. The procedure of marriage  

 By following the procedure outlined above, the Philippine national will no longer have to change his or her status. The Philippine national will now be recognized as the spouse of a Japanese national, and as such will be entitled to reside in Japan upon entry and to renew his or her visa before its date of expiration.

Note:  The submission of a certificate of eligibility along with a visa application form, to the Consulate General of Japan in Manila, does not necessarily guarantee that an entry visa will be issued to the spouse of a Japanese national.

Remember: If the Filipino applicant intends to stay in Japan for more than 90 days, he or she must register as an alien at the city hall of the city in Japan in which his or her Japanese spouse resides.
